2. Service Description

Feedsly.io is a subscription-based software platform designed to assist users in curating, managing, scheduling, and analyzing their content for the Instagram platform.

Instagram Account Connection

• Authorization: The Service requires you to connect your Instagram account(s) via the official Instagram/Meta API. By connecting your account, you grant Feedsly.io the necessary permissions and authorization to access, display, and perform actions on your behalf (such as scheduling and posting content) as outlined by the Service's functionality.
• API Compliance: You acknowledge that Feedsly.io's Service is dependent on the Instagram/Meta API and its terms. We are not liable for any changes, outages, or termination of access caused by Instagram/Meta.
• Your Responsibility: You are solely responsible for ensuring that your use of Feedsly.io and any content you post complies with the Instagram Terms of Use and Community Guidelines.

3. User Accounts and Registration

• Eligibility: The Service is intended for users who are at least 18 years old or the age of majority in your jurisdiction.
• Account Information: You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
• Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your password or account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4. Payment, Subscriptions, and Cancellation

• License Grant to Feedsly.io: By submitting User Content, you grant Feedsly.io a worldwide, royalty-free, non-exclusive, sub-licensable license to use, reproduce, modify, adapt, publish, and distribute the User Content solely for the purpose of providing and improving the Service (e.g., displaying the content in your calendar, uploading it to Instagram on your behalf, or performing analytics).

6. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. As a user of the Service, you agree not to:

• Use the Service to violate any applicable law or regulation, including Instagram's rules.
• Systematically retrieve data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Attempt to bypass any measures of the Service designed to prevent or restrict access to the Service, or any portion of the Service.
• Use the Service for any revenue-generating endeavor or commercial enterprise other than for managing your own Instagram account(s) as intended by the Service.
• Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

7. Termination

A. Termination by User

You may terminate your account and subscription at any time by following the cancellation process within the Service's account settings or by contacting our support team. Termination will take effect at the end of your current paid billing cycle.

B. Termination by Company

We may suspend or terminate your account and your access to the Service, at our sole discretion, immediately and without prior notice if you breach any part of these Terms, including but not limited to failure to pay fees when due or engaging in prohibited activities.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

B. Limitation of Liability

IN NO EVENT WILL FEEDSLY.IO OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICE DURING THE [Number, e.g., six (6)] MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
